TERMS & CONDITIONS FOR CLIENTS AND CLEANERS (UNITED STATES & CANADA)

THE TERMS AND CONDITIONS STATED HEREIN (COLLECTIVELY, THIS "AGREEMENT") CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU ("USER" OR "YOU"), WHETHER AS A CLIENT OR INDEPENDENT CLEANER, AND ACTUALLY CLEAN LLC, A MICHIGAN-BASED LIMITED LIABILITY COMPANY ("ACTUALLY CLEAN," "COMPANY," "WE," OR "US"), GOVERNING YOUR USE OF OUR SERVICES, WEBSITE LOCATED AT HTTPS://BOOKACTUALLYCLEAN.COM (THE "PLATFORM"), ECOSENSE REFILL™ SERVICES, CLEAN LIVING CLUB™ MEMBERSHIPS, AND ANY ASSOCIATED MOBILE OR SOFTWARE APPLICATIONS (THE "SOFTWARE").

BY USING OUR PLATFORM OR SERVICE, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE PLATFORM OR SERVICES. THESE TERMS INCLUDE AN AGREEMENT TO ARBITRATE DISPUTES, DISCLAIMERS OF WARRANTIES, AND LIMITATIONS OF LIABILITY.

ACTUALLY CLEAN DOES NOT PROVIDE CLEANING SERVICES AND IS NOT A CLEANING SERVICE PROVIDER. IT IS UP TO THE THIRD-PARTY CLEANING SERVICE PROVIDER TO OFFER CLEANING SERVICES WHICH MAY BE SCHEDULED THROUGH USE OF THE SOFTWARE OR SERVICE. ACTUALLY CLEAN OFFERS INFORMATION AND A METHOD TO OBTAIN SUCH THIRD-PARTY CLEANING SERVICES, BUT DOES NOT AND DOES NOT INTEND TO PROVIDE CLEANING SERVICES OR ACT IN ANY WAY AS A CLEANING SERVICE PROVIDER, AND HAS NO RESPONSIBILITY OR LIABILITY FOR ANY CLEANING SERVICES PROVIDED TO YOU BY SUCH THIRD PARTIES.

PLEASE READ THESE TERMS OF SERVICE CAREFULLY, AS THEY CONTAIN AN AGREEMENT TO ARBITRATE AND OTHER IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS. THE AGREEMENT TO ARBITRATE REQUIRES (WITH LIMITED EXCEPTION) THAT YOU SUBMIT CLAIMS YOU HAVE AGAINST US TO BINDING AND FINAL ARBITRATION, AND FURTHER (1) YOU WILL ONLY BE PERMITTED TO PURSUE CLAIMS AGAINST ACTUALLY CLEAN ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION OR PROCEEDING, (2) YOU WILL ONLY BE PERMITTED TO SEEK RELIEF (INCLUDING MONETARY, INJUNCTIVE, AND DECLARATORY RELIEF) ON AN INDIVIDUAL BASIS, AND (3) YOU MAY NOT BE ABLE TO HAVE ANY CLAIMS YOU HAVE AGAINST US RESOLVED BY A JURY OR IN A COURT OF LAW.

PAYMENT TERMSAll payments for services booked through Actually Clean are processed via our secure third-party payment processor. A prior authorization for the full amount of the cleaning is placed on your payment method the evening before services are rendered. Payment is processed immediately following service completion. By booking a service, you authorize us to charge the payment method on file for the full service amount, including applicable taxes and fees. Tips to service providers are optional and can be added at checkout.

CLEAN LIVING CLUB™ MEMBERSHIP TERMSThe Clean Living Club™ is a recurring monthly membership that includes discounted cleaning rates, early booking access, and members-only wellness perks. Your membership will auto-renew each month until canceled. You may cancel anytime through your account dashboard. If canceled mid-cycle, your benefits will remain active until the end of the billing period. No refunds will be issued for unused days.

ECOSENSE REFILL™ SUBSCRIPTION POLICY The EcoSense Refill™ Subscription provides recurring delivery of eco-friendly cleaning refills. By enrolling, you agree to recurring charges and shipment frequency based on your selected plan. You can modify, skip, or cancel your subscription anytime through your account. Returns of used or opened refill products are not permitted. Shipping fees are non-refundable.

THEFT AND DAMAGE POLICY Actually Clean is a platform that connects clients with independent service providers. While we encourage professionalism, we are not liable for theft or damages. Clients must report incidents within 7 days of service via contact@bookactuallyclean.com. Claims will be mediated in good faith. 

COMMUNICATIONS By using the platform, you consent to receive texts, calls, and emails regarding your bookings, service updates, promotional offers, and feedback requests. You can opt out of promotional communications at any time, though transactional and service-related messages are mandatory.

LICENSE AND SOFTWARE USE You are granted a limited, non-exclusive, non-transferable license to use the Actually Clean platform solely for booking and managing services. You may not reverse-engineer, modify, or resell our platform or its content.

INTELLECTUAL PROPERTY RIGHTS All content, logos, software, and trademarks on the Actually Clean platform are owned by Actually Clean LLC or its licensors. Unauthorized use is strictly prohibited.

PRIVACY AND COPYRIGHT Your personal information is governed by our Privacy Policy. If you believe any content on our site infringes on your copyright, please contact us immediately with supporting evidence and identification.

THIRD PARTY INTERACTIONS Interactions with third-party service providers are solely between you and the provider. Actually Clean does not supervise or guarantee the conduct, work quality, or safety practices of any cleaner.

REFUND & CANCELLATION POLICIES Cancellations made with less than 6 hours’ notice may incur a $100 fee. Lockouts where the cleaner cannot access the property will be treated as a same-day cancellation. Refunds are not guaranteed and are evaluated on a case-by-case basis.

LIMITATION OF LIABILITY To the maximum extent permitted by law, Actually Clean is not liable for indirect, incidental, punitive, or consequential damages related to your use of the platform or services. Our liability in any case shall not exceed the fees paid by you in the past 6 months.

DISPUTE RESOLUTION (INCLUDING BINDING ARBITRATION) Disputes must first be addressed via informal negotiation. If unresolved, disputes will be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. By agreeing to these terms, you waive your right to a jury trial and to participate in class actions.

GENERAL DISCLAIMERS AND GOVERNING LAW The services provided by cleaners are "as is" and "as available." Actually Clean makes no guarantees about availability, accuracy, or reliability. These Terms shall be governed by the laws of the State of Michigan, without regard to conflict of law principles. Jurisdiction shall lie exclusively in the courts located in Wayne County, Michigan.
